I think executioners swing is brilliantly designed. Not only has it been said that it fits in the orzhov flavor for punishing a wrongdoer, but it is describing a executioners SWING not an DECAPITATION, therefore I think it completely relevant to leave the creature maimed if the creature's toughness was enough to absorb the strength of the swing. It would still leave it weak though, from a fresh near fatal wound.
