I don't know if I'd call you a nice guy. Nice guys don't complain about their good deeds and they don't need compensation for their work. You should be proud and honored when you do a good deed, no matter if it costs you an arm or a leg, because its your choice.

I didn't complain about it at all at first. But after I found out she blatantly lied as to how far away she lived, yah, I got annoyed. Who wouldn't?

And if I wasn't being a nice guy, then what was I being? Selfish?

I mean, driving a random drunk girl home is kinda annoying but at least she paid you and the cop didn't even pull you over. When a cop doesn't pull me over, I know its time to break out the champagne!

You should probably re-read it broski. She said she'd reimburse me when we got there, and when I pulled to the office, she dipped and never returned.

But I suppose that would be my fault too, to trust her like that, right?

Did he dump his problem on you? No, otherwise this wouldn't be "charity work", besides, you were just drinking a second ago in your story and this girl was passed out, there is no immediate need to help anyone here.

Again, you should probably spend some time and actually read my post. He really DID pass his problem onto me, because he had promised her a ride back at the end of the night, and he drank enough to put himself out of commission, knowing he had a responsibility to her.

Also, she was not passed out. We were all quite sober.

Get your friends to do it. Standing up for yourself every once in a while is not being a jerk. Being a jerk is when you have bad attitude.

Get my friend to do it? My friend, that's so wasted he can barely form a cogent sentence on his own?

Then how do you think I would feel when I opened up the next mornings newspaper and see that he's killed himself and maybe others because I bugged him to take her home?

Be someone you can be proud of.

Rolleyes Yah, I made sure a complete stranger got home safe as opposed to being splattered over asphalt. I have no reason to be proud...

You had my sympathy, until you said you were lost but yet you have a fancy GPS.

Yah, it was a real piece of equipment...a 6 year old GPS.

The reason people have GPS is so that they will never be lost.

We eventually just had to backtrack, after it tried to take us a route that would have added about 30 minutes to the trip. Not cool.

Oh, yea, and the fact that you didn't even know her. What do you expect when you trust a complete stranger? I understand the whole "we should be able to trust people" I am just saying in this situation I wouldn't have been so suprised to have been had, heck I might have even seen it coming.

I'm just dissapointed in her. I'm angry with my friend for dumping his problem on me.

Ok, so after tonite, my charity bag is closed. At least for a long, long while....

So, it starts with me seeing a friend of mine chilling in his car outside his apartment. I decided to see whats up, and I find out hes with a lady friend, and they're taking down some beer. I have a friend of mine with me, so I break out a couple Coronas and get to drinking with them.

Time passes, and eventually me and my friend go inside to finish off the evening. About an hour later someone knocks on the door; its the girl from earlier.

She tells me that our friend (I have no idea how he knows her), got too drunk and passed out in his apartment, and she needs a ride home. I ask her how far away it is, and she says about 15 mins (I live in Moreno Valley, and she told me it was a little before Pomona, if anyone knows the area).

I tell ok, but that I have to wait till ten to grab the whip, when my girl goes into work. So we wait, ten rolls around, and I grab the car, and mob out with her and my friend from ealier.

So, we head out. We get near Pomona, so I ask her how far.

She tells me to keep going, its about ten more minutes. After stifling a casutic remark I was about to throw her way, I tell her to just lemme know when we are getting close. So we keep going. And going.

    And going.

Eventually we hit hemet, a good half hour away, and she tells me to exit the freeway. I thankfully oblige.

So we get off, and we hop onto another street. She tells me to just keep going; she'll tell me when to turn. So we keep going. And going.

    And going.

Now, at this point, I have to ask her why she would tell me its a 15 minute drive, when its looking like its about to be a 45 minute, if not more, drive. She makes up some lame excuse about using different directions, so I just blow it off, and keep going (at this point I'm stuck).

We spend another ten minutes on that road, with me being thouroughly, genuinly pissed off (that doesn't happen often). I kindly, forcefully, demand her she at least give me some gas money. She agrees to give me ten, so at least the trip won't be a total loss.

So, after about a 50 minute drive one way, we get to her trailer park, in hemet (no joke), and she tells me to park in the office while she runs to get the ten dollars. So I wait. And wait.

    And wait.

So about thirty minutes later, I decided to stop lying to myself and admit I've been had. Not only did she get me to take her all the way to Hemet, she completely got over me for gas money as well.

At this point, both me and my friend are understandably pissed. And lost.

So I try to take a breather, punch my home into the GPS, and we start the long trek home.

    But, things get even better!

The GPS decides to take us through a road thats 'supposed' to be closed off, and makes us waste another 20 minutes going down that road, only to have it closed off right before the freeway. So, we turn around and start back where we came from.

While heading back, a cop spots us and decided to start following us. Now, mind you, here I am, sitting in a car thats not in my name, on a road thats supposed to be closed, with my girls purse and wallet inside, and with me having no way of proving I know her. So if I get pulled, we're pretty much both going to jail, and the cars getting impounded.

So, he follows us the whole length, running my plate and just tailgating me the whole way, while I sit there ☺☺☺☺ting bricks.

We finally get to the end, and I watch with relief as he turns onto a side street behind us.

So we get back to the freeway, spend another 50 minutes getting back, and finally get home.

So, I drop him off, and go to drop the car off at my girls work.

So I drop the keys off, and find out, as a special ending to my night, shes absolutely livid with me for being gone almost two hours longer then I told her, with a girl she really doesn't know.

Sigh...thats pretty much my rant. I don't know if the cosmos is keeping track, but karma definitely owes me one for this.

It would take a really incompetent judge to rule in your friends favor after this statement right here. The police report will show he had a beer in his possession. All it takes is the defense to argue that maybe ha had drank it as he left the police station or maybe it was his 4th or 5th. Not having a breathalyzer hurts him really bad here if he was sober.

I agree that he really doesn't have a case against the cops, but as far as the beer goes, isn't that why there is a legal limit for being drunk? Just because he had a beer on him as he left, shouldn't really be enough to throw his case out. It's one thing to argue that he may possibly be impaired, but a whole other issue to actually prove it.

I'm going to try to get a hold of the report, so I at least know the full amount of details they decided to put in, and what they omitted.

Unless the police report shows the car was speeding then he is boned in every way possible on this. The car owners insurance is going to argue that he was violating the law and they don't have to pay and they would be in the right here.

The police really have no way of knowing what speed he was going, so I guess it's up to the insurance to decide if its a big enough chance to take it to court, instead of settling.

And yes, he did J-walk, but he was forced to, due to the sidwalk and streetlights ending on the side he was walking on. Walking down an unlighted dirt shoulder is many times more dangerous then taking the risk of J-walking. That should at least be considered.

A 20 foot skid mark is actually pretty short for 40 miles an hour in a regular sized car. It takes about 1 foot for every mile per hour to stop a car in perfect conditions. And bumpers are made to absorb impact so it shearing off is actually good for your friend that means it did its job and gave some.

Like I said, I really have no way in verifying what speed he was actually going, but given the fact the the bumper was sheered off hard enough to be hurled all the way to the side of the street, and that te break wasn't merely a fracture, but a complete break, it seems he has a good case to make for the driver being over the speed limit. That particular street is very heavy on foot traffic as well as vehicle traffic, so the speed limit is lower then usual for a reason.

I'm not entirely sure about the skidmark; he mostly just gave an estimate. From what I've heard, the police report was very bare, which should work in his favor, at least for going for the mans insurance.

EDIT: And to make it clear, he didn't have 'some' beer, he had one 12 oz can.

Was your friend drunk or high at the time? Actually, the better question is "could it be argued that your friend was drunk or high at the time?"

I believe in cases like this, it will often be defended that the plaintiff (your friend) was, himself, negligent. It will not look well if he was impaired in any way.

I really don't think that would be a factor. He had had a beer with me a couple hours before, but no breathalyzer was taken, and there was no mention of alcohol involved in the police report.

It turns out, the cop ended up giving him a ticket for J-Walking after he got hit.

You think that would be enough to pass liability onto him, making his attempt at a settlement void?

Ok, so, needless to say, my friend had a real bad night a couple of days ago...

It starts off with him going down to the local gas station to grab a beer, as we usually do. When he gets down there, he decides to hang outside a little bit, have a smoke. A couple minutes later the clerk comes running out, yelling at him in what he presumed was Arabic. He tries to be polite, and explain to the clerk that he wasn't pan-handling, he was just finishing off his cig. After that fails, he decides to just leave and come back a bit later.

    So, he does.

But when hes walking out with his beer, a cop rolls up on him, and throws the cuffs on him (the clerk called the cops on him). He runs my friends name, finds out he has a warrant for Marijuana, and takes him down to the station.

So, at the station, he writes him a ticket, gives him his beer back, and sends him on his way (it was about 1:30-2 am in the morning at this point).

So, while on the way home, hes walking down the street, and the sidewalk ends (as does the streetlights). Hes not a stupid man, so he crosses the street to get to the paved, lighted side of the street.

As hes crossing the street, he looks to the left and sees a car barreling down on him. He lunges towards the pavement, and narrowly avoids getting splattered over the windshield. But, unfortunately, he doesn't come out unscathed, and his leg gets hit, snapping it and causing both bones to spear through the skin. So the car pulls over, the guy runs to him, sees if hes ok, then spends the next 4 minutes in his car while waiting for paramedics, while my friend is bleeding in the middle of the road.

He wasn't sure exactly how fast he was going, but he hit him hard enough to sheer his bumper off, and leave about a 20 foot stretch of skidmarks when he attempted to stop (the speed limit is 40 on that street).

Now, would he have a case to sue the man (he was insured)? Or the cops, for negligence? (considering they scooped him up a street down from his home, and let him walk 5 miles back home at 2 in the morning, all over a Marijuana warrant, in which the cop could have easily written him the ticket right there, at the gas station)

Nope, just expressing that such an arduous journey with degrees of separation are the norm to deal with minorities.

Can you not see the difference between what groups of humans have to go through, and what issues a group of large, hairy, inarticulate creatures of an entire different species?

Or are you just trying to be deliberately obtuse?

There would be no 'journey' for these individuals. The only ways they would even be begrudgingly accepted in any way shape or form into any human society would be
a.)Somehow convince people to take the Neanderthals on as a huge financial burden. Because they would die en masse if interjected into society without constant support and babysitting.

b.)Somehow convince the whole of society to change its habits and workings to deal with the Neanderthals impairments...because it wouldn't matter how hard they tried to successfully communicate, if no ones going to bother to understand.

c.)Overcome the basic human urge (on a grand scale) to fear and hate those that are different.

Does that sound even remotely feasible to you?

This already exists with humans, and these folks have since adapted and hedge out social niches for themselves with some assistance. As we "progress" as a society, discrimination becomes less normative and acceptance rises. De facto discrimination exists and will always exist, but we have Case Law to deal with acts of discrimination.

    Bolded the important part.

    Humans. Not Neanderthals.

Nope, neither do you to report that they have a distinct disadvantage over current humans that look different and have a disability.

Except I'm not the one making outrageous claims about them being able to find some special niche, en masse, ala Rain Man or something....

I used the example of "deaf culture" to provide a context for such a people existing with a unique disability. Even then there are people that refuse cochlear implants in order to continue being identified as "deaf." People adapt either way, and there's no reason why a Neanderthal could not if taking the axiom of ceteris parabis on intelligence and adaptability to a homo sapien sapien (not archaius).

So dump them on the curb, and hope for the best?

I think that sums up your paragraph pretty well.

So what happens when they don't adapt, and when society doesn't progress with them?

Are you going to be the one to dig the graves?

The simplest thing is "we don't know until we try."

And again, what happens when it fails? Forced vasectomies on birth, let them watch in horror as their species dies out again? Or maybe just support them for as long as they are a species?

We already deal with people on the autism spectrum that think very differently than other people. At worst the creation of a neanderthal would create a homonid that functioned "below" average human intelligence, and we have ways of dealing with these people to grant them independence.

I think you're being extremely naive in assuming that society will just change and make room for a whole new species.

You cannot sit here and tell me that a speech impediment such as the ones they would face would not be detrimental for them. Human society, as it is now, is much more likely to simply ostracize them then accept them. And forcing them unto society (ala affirmative action) will only breed more contempt.

Different is a definite yes, but we have the ability to deal with those issues. Using the autism spectrum again, there are specific intelligent jobs that people on the spectrum that are able to go onto college and excel can do jobs that "normal people" don't necessarily have the concentration skills for.

You have no basis in assuming they would have any such 'special skill'...

We presume that the average neanderthal not being able to say some sounds would relegate their speech inaudible to humans. There are multiple languages in the world that make different sounds that would be more natural for the neanderthal to become fluent in.

Actually, most scientists believe the speech impairment was more profound then what you think...problems of note being certain vowels, and deep sounds, like 'Oooh'. I can't think of any language they would be able to just 'become fluent' in.

You may not want to buy a ticket...but there's six billion other people on this earth...and most of them are quite ignorant and vicious.

    What is the problem?

Other then the fact that they would live completely awful lives in today's world? Who would employ someone with such a sever speech impairment, when there are thousands of humans who would jump at the job, just the same?

They would need constant support to be able to function in any way in our society. So you're proposing we take on this humongous financial burden, why exactly?

We have a "deaf culture," albeit a fading one, and people with inabilities to speak. One such famous example is Stephen Hawking. Let us presume that intelligence is ceteris parabis and that a neanderthal can function "humanely" in "civil society," and considering these subcultures and successes of people with disabilities these Neanderthals would be at a disadvantage but not crippled. In some cases, they would be successful.

So, some of the Neanderthals would turn their disability into a positive aspect of their lives, and the rest of the entire species would suffer with it.

That doesn't seem too moral to me...

Neanderthals had higher larynx's, which makes the intricacy of human speech impossible. That alone would create a humongous rift between the two species. If humans can barely tolerate other races of their own species, how well do you think the Neanderthals would fare?

The color barrier is one thing, but a language barrier that dramatic? All I could see coming from this is hate and intolerance...
