LOL that was funny!

I think if you carry your self with confidence. People will see it in you and be less apt to judging you "as a girl".

I would like to point out that boxes cost less from online stores because their costs are generally less and they get them at distributor prices, whereas it costs more from your local gaming store because they have to pay costs that online stores don't necessarily have- phone, rent, lights etc whereas online stores are paying for their server costs primarily, and maybe running their business from home. My family runs some online business stuff, and it doesn't cost nearly as much as running an actual storefront.

Online shops are damned near criminal imo, and i'm glad WOTC is at least now trying to shut them down, if albeit it's a bit too late. Online shops are a problem because all these gamers buy all their product from them, and don't support their local stores by buying from them. And guess what folks, if you don't support your local stores, they will end up having to close and thus you have nowhere to play, casually or in tournaments.

So sure, go ahead, buy your boxes online to save a whole $10 a box after shipping. But don't whine later when all your local magic stores have closed. And yes, it is a real problem with real consequences. In the past year about 4 magic stores in my state have closed- and we're not a large state. the pros of buying product from real stores- you keep them open so you have somewhere to play, you get it the day of the release and don't have to wait for shipping, and all for what? $10 more most times if you buy from someplace like SCG. The problem is magic players just don't have any loyalty. Especially Standard players, they'd rather buy all their cards on ebay or online for the cheapest price rather than support a store. Uhg.

I see what you’re saying and agree. I would only point this out. The economy is changing, and people buy what is the lest expensive. 10 $ is not a lot of money at all, but to some it is a whole heck of a lot. You can’t have a lot of money if you spend a lot of money.

I don’t work hard to spend my money getting something at place a, I could get for cheaper at point b. It’s just a waist. Think about this. If you saved 10 a month for a year... that’s 120. That’s a new pair of shoes a nice dinner out.

I’m telling you it does not seam like much, but when you "pinch pennies" and research everything you buy look and see how much money is left in your account come the end of the month. You may call it silly or what ever, but come and talk to me when your 65 and should be retired but can’t be.

I don’t like to see a local shop close. But we do live in the modern age. I’m working to support my self and loved ones (and to pay taxes to support this country. Grin ) Not to keep a store in business. It sounds really harsh, but it’s simple high school economics.

All this being said. I will be buying a booster box, a turny box and a fat pack from my local store this Friday. The extra $ is worth it to me to not have to wait a week for delivery. And it will help them out in the precess.
    Supply and Demand...

The sight looks really nice. I like the layout and the idea of it.
I would have to say the information is not up to date, and to run a spell check/have a friend proof read it.

    Other then that nice job.

I like the challenge of building a deck that is not apparently a “pro” or top 8 deck and making the best out of it. I don’t like coming out and straight winning on turn 3. I like a challenge. The main draw to magic for me is building my own deck. I (personally) don’t see what’s so fun about playing a deck someone else made. It’s like buying an already leveled toon on some mmo game.

I don’t think it’s because you’re a girl. I just think the 1st guy probably thought he was some “l33t” mtg player. But no one will ever know. He probably talks to his mother the same way, and probably his grandmother.

The 2nd guy probably has been getting junk form people half his age all day and was at a point he was done with it. Next time you get a bad attitude from a worker ask for the manager and say “I think *point to the rude guy* needs a break he apparently not feeling it right now.” And leave it at that. Your not giving the manager anything to get the worker into trouble, If he/she needs/wants/likes his/her job it’s usually enough for them.

Can Amazon then publish the New York Times bestseller list? If the answer to that question is a clear "yes," then why did Amazon have to offer concessions to get NYT to back off their threat of an infringement suit?

Correct me if I’m wrong but you did mention you having a background in law like my self in a previous post. So let me ask you this. Can you buy a copy of the NYT bestseller list and edit as you wish and make a “better NYTBS list” and still call it the NYT bestseller list? Can you buy magic cards and build your own deck and still call it a magic deck. See what I’m saying? The purpose of the game is to make your own deck.

I'd also like to note that, above, you said "Now if you were to say 'I got this deck from SCG' you’re walking a different path." I take it that this is no longer your position - that whether one admits to the copying or not makes no difference as to the legality of the copying?

That if you read the post and the other posts individually in context to the reply I was offering at the time. You will see I was referring to taking the article form SCG. (Article in this case the story and the deck list including the story associated with the list.)

You can't just change what you are saying after you have said it. Myself and others have mentioned MULTIPLE times that provability is not the issue in this thread. you are the one who has been selectively ignoring it.

The issue is "is it illegal to post the deck that you copied?" NOT "can SCG prove that I copied this illegally"

Additionally the multiple infractions / warnings you have had don't help your credibility much.

Now that you cleared up the matter ill give my fanal answer.
    • SCG has no contract between them and WOTC. Stating they can freely post card decks with cards made by WOTC. (that I know of, and we will say for the sake of argument they don’t)
So by your logic WOTC can take action against SCG for making such posts. Or anyone for that matter. But the laws DOES IN FACT prohibit them from being able to do so. In THIS SPECIFIC MATTER.

    • No contract would ever be made because, WOTC frankly does NOT care who makes posts featuring decks of cards made by WOTC. AND they are making a TCG and SALE a product with a format that warrants if you will the posting of different cards, and builds. (I’m not breaking this one down for you, it is complicated if you don’t understand points 1, 2 and 3 in this post)
    • Because SCG has no agreement with WOTC. SCG cannot take action against someone using a deck list that was posted on SCG webpage featuring cards who’s CC is owned by WOTC and not SCG.
So it’s not as easy as “"is it illegal to post the deck that you copied?" IN what context are you reposting it? If you include anything other then the CADR LIST ITS SELF, It can fall under copyright restriction laws. If you are just posting a card list EVEN IF you say I got this Card list form SCG, as long as nothing but the CARD LIST is reposted. It is not illegal.

    Hope this clears it up.

Are you aware, then, that it's possible to have a copyright in a compilation of items, even if you don't have a copyright in the items themselves? Because every time anyone mentions that, you just start waving around your supposed law degree.

Assuming you're aware of that, please explain how the NYT bestseller list (from my post above) is any different from this.

I’m getting the feeling no one is actually reading ALL of my posts, or using selective reading.
I’m talking about 2 different things.

1: an ARTICLE that mentions a deck in the CONTENTS of an ARTICLE referring to more then THE DECK ITSSELF. This DOES FALL under copyright protection.
2: A deck you play the game with.

Can you post an ARTICLE form SCG… Not with out premission.
Can you post a deck list you got from STG and leave out the article its self? YES, BECAUSE YOU CAN’T PROVE THE DECK LIST CAME FORM SCG.

Now if you were to say “I got this deck from SCG” you’re walking a different path.

But I have mentioned this multiple times.

(also not an attack) Could you then perhaps provide some support for your argument? I'm not trying to say that you are wrong, but I would like some support rather than a bald "they can't do it because I said so."

Who has ever said that Wizards could not sue you for taking a verbatim list and posting it on another web site under the heading "Hey look at this deck I just copied from magicthegathering.com" I'm arguing that they COULD sue for that, and in the same veign SCG could sue for a deck design.

I'll grant that it would not be a very extensive copyright (most likely ONLY covering that EXACT deck) and it would be virtually impossible to enforce... but the copyright woul still "exist."

Just to make sure: Are we both applying US copyright law? (Only curious because "mate" isn't typical US slang)

I went here and work for a Law Firm In New York City. But if you read my first post on the matter you would see. I mentioned I know maybe just a little something about the law as it pertains to this case. Might not be as knowledgeable as the guy who posts on this thread that works in oh I don’t know any other field but law.

Why would the fact that specific card titles are copyright WOTC prevent a compilation of some of those titles from being copyright someone else?

case in point: If I make an advertisement for widgets, and said advertisement is run on a quarter page of a newspaper with a bunch of other stuff I own the copyright on the advertisement, but the newspaper owns a copyright on the entire layout of the page.

You’re kidding right? Not an attack mate, but did you read all of my posts or just one? If you go back and read all of them you will (hopefully) get what I was referring to. And possibly how I know I know what im talking about.

Your analogy has holes in it. What are you advertising for? What’s the reason of the advertisement? Are you posting it for people to seeing how you have stacked 75 different color widgets in a pattern for a contest that millions of people are in on? See my point. There is a difference in you analogy and the fact NO ONE CAN COPYRIGHT A DECK LIST BUT WOTC. Take for instance a theme deck. Can WOTC sue or take legal action against you if you post the lay out of “Sliver Evolution” theme deck? If WOTC can’t sue you, how is SCG.

And there is a difference in a DECK LIST, and an ARTICLE LISTING cards. If you remove the article and just use the cards SCG has nothing.
