So recently I made a purchase from a guy, who shipped me his end and provided me with DC, albeit a couple of weeks late. Anyway, his package ended up showing up via online tracking as delivered around 2pm, however no actual mail was delivered at the time. Two other packages from other transactions arrive around 4pm, one with DC, and calls to USPS confirm two packages were delivered, which is what I received. USPS definitely delivers only once a day at my address, so it's inconceivable that it occurred twice. Besides, I checked for mail at regular intervals and did not note anything at all until 4pm.
So, apparently USPS lost the package or probably delivered it to the wrong address. Since there was no insurance on the package, USPS will likely not be responsible for it. In such an instance, would I, as the buyer be liable or the seller? How would paypal view it (transaction for goods, non-gift)? Would it side with the seller or the buyer?
Theoretically, the seller could question whether I had actually received the cards, although I've generated paperwork and have meticulous notes on what packages and cards come on which days. I've also filed an incident report with USPS which should hopefully ameliorate this concern, and on my end I could question whether the seller provided the correct shipping address or whatnot, but at the end of the day I'm pretty sure it's on USPS. So...what now

Was it on this site? If so, open a BTR and let the mods solve it.
If it was off site I would visit the people in your area and see if they got your mail.

I have seen this happen several times. Be patient. Every time an item has shown up on the tracking system as "delivered", it has shown up within a day or two. I have no idea how or why it can happen, but I have seen it enough to say that this is not an unusual situation. Don't fret. All will most likely be OK.

If possible go to the po and have them check if they any packages for you. I had something similar happen to me a while back. The DC said delivered didn't leave the package or a note. I went there to check and they had it. The mailman just screwed up.
Yup I checked with the PO No such luck so far, maybe tomorrow I'll get some good news. If not though...what happens? Does the seller lose, the buyer lose, they each split, or?

I've had this happen to me. It was a good samaritan returning mail to its rightful owner.

I had this happen on a sale here as well. Bought an Unlimited Bayou from someone, he shipped with DC after he received payment. DC said it was delivered to my apartment complex and I never received. USPS only ever puts packages in our package lockers or gives them to the front desk, yet they never had one for me that contained my item. It's kind of a pain because it wasn't the guy's fault and there's not really anything he can do about it because it definitely said the package had been delivered to me. Totally sucks.
Typically it is the sellers responsibility to get the cards to you. My concern would be with how the package was addressed. For me, most times with DC it is accurate. If it was accurate for your package, it was delivered elsewhere earlier in the day it would appear.

So long as the purchase is under $250 and paypal shipping with delivery conformation was used, then the seller would not be held liable so long as the package did in fact show up as delivered. If the amount is over $250, then signiture conformation would be required in order for the seller to still be covered. See below for more information:

Doh, thanks for the input guys, it's not sounding good Would anything change if USPS would issue a statement saying they didn't in fact deliver the package? My local office has acknowledged that they did not deliver it to my address and are scrambling to find where they may have misdelivered it, and I actually have a cctv system for the mail, so I have evidence nobody showed up at the time the mail was delivered, and I have video of when my other package with DC arrived.
