I’ve read that Penance can be used even without any source to choose as you choose upon the resolution, but what I’m wondering is the ruling associated with this that allows it to happen? Also to clarify that if there’s at least one choice available that I have to choose one? Looking to use this for a Yennett, Cryptic Sovereign deck to basically put back any and all cards from my hand on top at instant speed. Thanks in advance

Because the word "target" is never used in the ability, it just calls for "the next time this turn". You can freely activate the ability and set up the damage prevention, knowingly, without anything to prevent.
If Yennett, Cryptic Sovereign is the only possible choice of a red or black source, then yes, you have to choose that one. You cannot simply ignore a mantdatory instruction. Only if the instruction is impossible to carry out will it be ignored.
Penance's ability doesn't target anything (C.R. 115.1c), and you don't choose a source for that ability until that ability resolves (C.R. 608.2d). You need only have a card in your hand to activate the ability (C.R. 118.3, 602.2b, 601.2h).

An ability on the stack is not a valid choice for the source.
119.7. The source of damage is the object that dealt it. If an effect requires a player to choose a source of damage, they may choose a permanent; a spell on the stack (including a permanent spell); any object referred to by an object on the stack, by a prevention or replacement effect that’s waiting to apply, or by a delayed triggered ability that’s waiting to trigger (even if that object is no longer in the zone it used to be in); or a face-up object in the command zone. A source doesn’t need to be capable of dealing damage to be a legal choice. See rule 609.7, “Sources of Damage.”
609.7. Some effects apply to damage from a source—for example, “The next time a red source of your choice would deal damage to you this turn, prevent that damage.”

If the source you choose is not Yennett, Cryptic Sovereign, then Yennett will have no trouble dealing damage. If it is, then the damage will be prevented.
