at my local game store last night there was a 15 year old kid playing against a guy known to be a bit of a hothead im two spots down from thhem at the table
. About halfway through the first round the kid plays thief of sanity and he must have swung and all i hear is "you are not touching my deck kid. you can shuffle it and thats it". Obviously some words were exchanged and a judge was called. The judge explained to him that he can either allow the card to basically do what it does or conceed. He lost and that pretty much sent him over the deep end. after the match the guy goes out for a smoke and the kid follows him out to apoligize maybe i dont really know. The next round parings are announced and neither the guy or the kid are there. Someone mentions that they both went out for a smoke and the judge goes to grab them. He then yells in the door for someone to call a ambulance. The kid is still in a coma as of this morning.
TLDR: kid played thief of sanity and pissed the guy off for touching his deck. guy then beat the kid into a coma. obvisouly charges are to be laid but the kids mom might be suing wizrds apparently.

I'm not entirely sure if WotC is really culpable in this. It'd be akin to someone suing Ford because some jerk decided to use one of their vehicles to commit a crime. I don't think any judge is going to look at that lawsuit with any seriousness.
I've seen folks almost come to blows over an EDH game. This story seems unlikely (& of course horrific) but entirely possible. We should all keep the flavor text from Fit of Rage in mind.
If this is real, I really hope they don't get off on temporary insanity, as mentioned by an above poster. People with explosive anger issues like this are a public danger, and even if their issues can be medicated away most of the time, and they had an explosive incident even after going to do a presumably calming thing like going for a smoke, and I wouldn't trust someone who'd even become a smoker (thus willingly addicting themselves and indicating poor responsibility, or recognizing the degree of their own issues and using smoking to medicate themselves but not managing it effectively enough despite knowing the issues) indicating that they aren't a responsible and reliable enough character to trust to manage their explosive anger in the future. I've heard some pretty scary stories about people with known explosive anger issues like this even in very controlled environments, because it isn't realistic to expect most people to perfectly follow doctors orders, and all it takes is a little slip coinciding with something that triggers the anger and then you have someone brutally injured or killed as a result.
Given the legal climate as far as corporate liability for consumer products is concerned, that "lawsuit" is going to get thrown right out in a New York minute by the judge. Though I'd be very surprised if events actually happened as described. I'd believe someone came to blows, but "beaten into a coma" would make the news. Not necessarily a lie but I would say likely embellished.
Oh and to the people talking about the insanity defense, that defense is almost never even attempted, and when it is, it has a vanishingly low success rate (plus you're still involuntarily confined if it succeeds). Even if this story is true, the insanity defense would not work for what seems more like aggravated assault.

I think it was a joke. Kid played theif of sanity. Guy lost his sanity and punched the kid.
This is not a thread that is appropriate for the forums as it is in regards to an assault that happened, where legal action could be involved. I'm going to be locking the thread in order to prevent further discussion on this topic,
