I am a bit unsure about what is considered OK and what is not considered OK when it comes to making proxies. Mostly I am focused on proxies for unoficial legacy tournaments or private cubes.
I am also wondering about using art assets from mtg when making banner, for instance on facebook or here on the forum. This is mostly a legal question , and also a question about what WotC polcey is.
1: What is OK to do when making proxies for using in cubes and unnoficial legacy games?
- Is it legal to print out copies on paper and use on the front of cards?
- Is it legal to make copies of mtg cards that are copies of mtg cards? (I am asuming no.)
- Is it legal to make copies of mtg cards that are copies of mtg cards, but clearly have them different? Like different art assets, layout, a fake exspansion symbol and different card backs. Perhaps even a water mark that says proxy or fake.
How about the 2 last points above, but you alter mtgcards you already own.
2: Can you freely use mtg art to make facebook banners or similar. Where goes the line from cultural reference, and plagerismn go here? Is there a diference between personal use, or public use?
I also asume some of these rules would be a problem with international law and change from country to country. I am from Scandinavia, I asume it will be a bit similar to USA and Europe, but small changes can occur.
Mind you, I am not out to counterfeight cards. I just realiced that my understanding of these laws might be different then what is actually true. So far people I have asked have mostly not being able to give a good awnser as this is complicated. Or the people who potensially know do not want to awnser as they do not like the subject. I can understand why, but as I said, I am merly cruius and want to understand this better.
Asking strangers who are most likely not lawyers for legal advice is sketchy.
However, when it comes to proxies, if they're not being used in sanctioned events and you're not distributing them, there isn't really that much for Wizards to act on. Fake cards are a problem for Wizards if people are using them in DCI events, or if they're damaging the Magic brand by distributing the fakes (whether for money or not).
On #2, Google "fair use", as that's the law that will apply (or not) depending on how you use the art.
Finally, the linked article describes what has been (and still is) Wizards' policy for years. It's not out of date for only being 2 years old.

The closent I found my my googling was this: https://magic.wizards.com/en/articles/archive/news/proxies-policy-and-communication-2016-01-14 I have a hard time trusting anything before 2016 as it is dated to that time.

However, it is a common recommendation to use a plains from revised and writing down the relevant information with a sharpie.
