After it's been declared an attacker in the declare attackers step it has deathtouch, which is not restricted to just combat damage. As long as the source of the damage is the creature, deathtouch will work. You can then use it when you have priority, either after declare attackers, after blockers are declared, or at the end of combat which is just before the second main phase.
Normally, uncounterable counterspells are cast in response to something that counters something of yours, so it's likely the Surge cost will be paid. Without the surge cost its really not good, so plan accordingly with this card or leave it out.
In that case they can just counter the original spell, the upside is when you absolutely want to stop something, not protect your own spell.
