Hello, I'm just looking to get some opinions on a current dispute I'm in with a store. I'm not going to use the name of the store as I'm still working with them on it and I don't want to slander their name if they make it right. So please let me know if you think I'm in the right or wrong here.
While browsing the stores website I noticed that they had NM Judge Promo Vendilion Cliques for $0.00 so as I'm sure anybody else would I bought the 3 that they had with full intention of them contacting me and letting me know that there was a price mistake which I would have been ok with. While checking out I was told by there site that I cannot make an order for $0.00 so I went and ordered about $10 worth of cards that I needed and sent it on its way. The order went through processing and then was shipped and nobody contacted me about any mistakes in pricing. When i got the package I opened it up and everything was in there except the Vendilion Cliques. This is the part that gets me, Included in the package was a receipt with an itemized list of what was ordered with the Cliques on there.
I contacted the store and let them know that my order was missing cards and what was missing and got back the response that there was a glitch and that is why we didn't sent the cards.
I responded back that nobody ever contacted me about any issues with my order and the order was processed and shipped. The receipt I have says that I am owed by the store 3 judge Cliques and if
I hadn't made any contact then the whole thing would have just flew under the radar. Somebody printed the receipt and packaged it with only half the order and sent it on the way without contacting me about it.
They apologized and told me that my issue would be forwarded to the business owner and they didn't even have the cards to give me anyway.
I have a screenshot of their website showing 3 Cliques available and now with him telling me that they didn't have them there could be 3 possible reasons.
1. They were falsely advertising.
2. They went and sold the cards to somebody else while I was in a dispute with them about sending them to me.
3. Whoever packaged the order knew that they wouldn't have to send it to me but saw in the stores site it showed they didn't have any in stock after the order so they pocketed the cliques for themselves.
I have waited two weeks and have gotten no contact from the business owner. As such I have filed a complaint with the BBB and hopefully they have better luck getting a hold of that person then I did. I know for a fact they had the cards at one point because I sold them three a couple weeks before I made the order. But I have not dismissed the possibility that somebody bought them before I tried to order them.
It also unsettles me that the website had a coded error for people who try to make orders with things in the cart but owe no money. Like they put things on there for $0.00 and then when somebody tries to get it they have to order extra only to be told they they won't be getting the item that was priced wrong but here is the stuff priced correct and thanks for your order. That is borderline mail fraud.
So who is wrong in this situation the customer or the store?
