I recently purchased a BGS 9.5 (9,9.5,9.5,9.5) UNL Dual Land from a large "reputable" dealer. I purchased it online so I wasn't able to physically inspect the card. When I received it, to my surprise, the back of the card had TWO roller lines across the entire back of the card and a finger nail indentation about 1 inch long. Obviously, the surface grade of 9.5 had been significantly mis-graded. I then contacted the store to see if I could just return the item. To my surprise, they said their policy is not to accept returns on any graded cards. Their recommendation was for me to take the issue up with Beckett. When I called Beckett, they said since I am not the originally grader of the card, I would have to send it back to the original grader and have them take up the issue with them. I circled back with the store owner at that point and he said he had no further recommendations for me, basically shutting the door.
Please keep in mind, I am trying to build a gem mint UNL set and I had to pay a premium for this card. But clearly, I did not receive what I paid for (at least in my opinion). I have my own feelings about what went down here but I'm not going to put any assumptions out there at this point. Just want to share my experience and put this information out there to see what you guys think.

There's a Store Discussion subforum; this probably belongs there. Beckett's customer service response seems asinine (the card is clearly misgraded; who cares if you're the original sender?), but the primary issue is with the store. They sold you a card that's in the wrong condition, and they refuse to make it right. Let the rest of us know what store it is, so that we can reconsider purchasing graded cards from them. Thank you.

I messaged the seller first.
Hi, The Plateau is beautiful from afar but upon closer inspection, it seems it has been mis-graded. There are two roller lines and some surface damage to the card. Unfortunately, I am looking for a true NM card as I am not just purchasing for the grade of the card. I m assuming it will be ok to return this item for a full refund? I attached some pictures to do my best to show the issues I m referring to. I am hoping this card will be re-graded before resold so someone in the community doesn t buy it overlooking this issue. Please let me know how I should proceed. Thank you.
They responded with:
Hello, this card was professionally graded by Beckett as a 9.5 and as stated in the auction we do not accept returns, sorry
I then escalated it with ebay and opened a case which ebay rejected within a few hours. I guess "is not as described" is the gray area here?
Also talked directly with the owner of Collector's Cache to no avail. He firmly stands by his policy of no returns and said my best bet was to contact Beckett. Reluctantly, I did and to my surprise they told me the original account holder (collector's cache) would have to take up the issue with them. So Beckett said I would have to send the card back to Collector's Cache and they could then contact Beckett about it. When I told the store owner this and asked for further recommendations, his response was he has no further recommendations.
I understand Collector's Cache is business but am I being unreasonable here?
I would state the business is being unresaonable here. EBay *should* side with you as the card is not as described. See if you can appeal the process. If that fails, contest it with your payment method (paypal/the credit card).

In cases such as this, eBay's automated buyer protection system can be rather complicated.
You will need to call and talk to someone with ebay customer service and explain the entire process to them (especially the part about how the card graders require that such complaints be initiated by the store that they originally dealt with) and where the issues are, along with having pictures accordingly which you seem to already have.
It really is an unfortunate thing when online sellers refuse to put customer service first, especially in perfectly understandable and reasonable situations such as this.
That said, from the store's perspective though, they had a card that was graded a certain way, sold the card as having been graded that way, and any attempt to take the card back for a refund would simply guarantee a certain amount of loss of money for them no matter what. And likely figuring that their unwillingness to accept returns will somehow shield them from having to accept returns (which is completely untrue and not how ebay/paypal policy works at all for buyer protection situations when items are received as being not as described.)
In most cases ebay will side with the buyer, especially with proper evidence that what was received was indeed not as described. This case is more complicated though as stated, as the issue was not that of the store, but rather the grader of the card. Hopefully ebay customer service when called will be more helpful for you, and be able to get that return processed. If not, then, when in doubt, try contacting paypal (assuming you paid via paypal presumably), and call them and explain the entire situation and see what they have to say. Since ebay and paypal are technically two separate entities its possible if ebay doesn't cooperate that paypal might.
Either way I wish you luck. Just remember that this isn't the fault of the seller, its the fault of the grader, so just try to continue being patient with the seller and let ebay customer service do their thing and hope for the best. At the end of the day though, it is the seller's responsibility to make certain that what is sold is completely as described and as graded in this case. IE: they should have double checked just to be certain one way or another (something it seems many sellers on ebay don't do). It should be the seller's responsibility to take the card back, and deal with sending it back in to have the grading fixed and get any sort of compensation accordingly if able. You should reasonably be able to mail it back to the seller for a full refund.
Is it the same card as featured in the auction? I assume it is, I imagine the first thing you would do is verify the serials. The artifacts are realy bad in those eBay photos so i can't see any blemishes. The Icy Manipulator auction looks like it has exactly the same back photo as the Dual Land.

Thanks for the suggestions and I'll consider escalating this with eBay, Paypal or my credit card company. It just kind of sucks I may spend more time and energy on this to no avail. In my opinion, a reputable seller that claims a 100% satisfaction guarantee shouldn't handle a situation this way. Whether I get the return or not at this point, the bottom line here is the seller clearly doesn't stand behind what they sold me. The seller (owner of collector's cache) even told me that if I file a claim with my credit card and win, the credit card company would reverse the funds from Paypal and in turn, Paypal or eBay would protect him and it wouldn't cost anything out of his pocket either way. So he said if I could get a refund that way, more power to me. My response to him was I'm not looking to get a free card out of this situation, I simply just want to return it for my money back. I also explained to him that I wanted to speak with him as a courtesy just to make sure there wasn't a misunderstanding before I decide how I would like to proceed.
He made it crystal clear to me that I was not getting a return and that it was their "policy" on graded cards. His recommendation to me was to take this issue up with Beckett because they should stand behind the cards they grade. He justified his stance by saying that they grade a lot of cards with Beckett and they don't have time to check each card in detail after the fact. He further added that they also have all types of collectors that come through their store and some people would be happy purchasing the card for the grade, some would crack it to play and some are "picky" like me. And he said who knows, in a few years the card will probably be worth more than what I paid for it...
After our conversation, I got in touch with Beckett and they simply told me because I am not the "account holder" of the card there is nothing they could do for me. They said I would have to send it back to the seller and to have them contact Beckett. I texted the owner back to tell him this and asked for what he recommended me to do at that point. His response: "No further Recommendations".
This whole situation just leaves me feeling very sour. From the information I relied on and was given, there was no reasonable way I could have predicted this issue with the card. But somehow I am left holding the bag. I'm hoping this situation is a rare occurence but I felt it was very important for me to share my experience. I certainly won't be buying or supporting anything related to collector's cache going forward.
@Savannahlion
I'm not sure if the pic is of the actual card. The tricky thing is they can say that it is and it would be very hard to prove otherwise. But the reasonable assumption would be that it is a pic of the same card. As a heads up, surface indentations and roller lines are not going to show up on scans.
@Vedast
Because there is still a human component to grading, I am sure mistakes are made. And I understand mistakes are made but to pass on the mistake this way to the end user is beyond me. The result is me paying a crazy premium for a non-gem mint card. I think surface automatically is a 7 or 8 with roller lines. With the inch long fingernail scratch/indentation I would assume the surface grade to be even lower in this case.
This situation reflects very poorly on both Collector's Cache and Beckett. Beckett obviously misgraded the card and you would think they would want to correct the situation rather than have examples of their poor grading out there. Collector's Cache is even worse since they are the party you are directly dealing with. The error in grading is so obvious they should have sold it as a 'misgraded' graded card. Not doing so is misrepresenting the card in my opinion. You should deal with Collector's Cache, and they should deal with Beckett to fix the grading and then they can sell it at a proper price. I have bought a lot of cards on ebay from Collector's Cache and I would not want to risk this kind of customer service on an expensive card. I will be wary of them in the future.
What exactly does 100% customer satisfaction guaranteed mean? That all of the satisfied customers make up 100% of the customers that are satisfied? I'd just call my credit card company and dispute it.

You'll note there's a unique serial number on the graded case. You can see it in the auction listing you posted - 0008522836. If you look at the card you actually received (you only posted pictures of the back, so can't verify that from what you've got here) you should be able to see if it's the same card. If it's not, your case becomes a lot stronger with eBay.

Just make sure you follow all of eBay/Paypal's policies before going through your credit card company. I'm not sure how it is now, but in the past if you went through the credit card company before going through eBay/Paypal, you'd lose your right to dispute through eBay/Paypal. That policy may have changed, but make sure to check it before doing anything.

So I have a Beckett account and checked that serial number. It comes back as an Unlimited Plateau with an overall grade of 9.5. Probably not going to win that one.
Card Serial Number: 0008522836
Set Name : 1993 Magic The Gathering Unlimited
Player Name : Plateau R :L:
Date Graded : Wednesday, March 18, 2015
Centering Grade : 9.0
Corner Grade : 9.5
Edges Grade : 9.5
Surfaces Grade : 9.5
Autograph Grade : 0.0
Final Grade : 9.5
The one that surprises me is the surface grade. That should not have been graded at a 9.5. Unfortunately I'm not sure you've got much recourse here if the seller is completely unwilling to work with you. You could try to get the seller to help you re-grade the card (You send it back on their behalf), but that won't fix your ultimate problem. you're going to be stuck with an (at best) 8.0 NM card that has been graded at 9.5.
Technically speaking, the seller didn't do anything wrong. They sent a card off for grading, got it back and listed it as is. The real fault here is with Beckett Grading. I know that doesn't help you because you're the one left holding the bag. I don't know if there is any precedent for purchasing cards that were incorrectly graded. you will have to do some research on that front since you spent money expecting a card to be in that condition solely on the reputation of that grading company. Good luck either way, and sorry this happened to you.

Right, but is the card he *actually received* number 0008522836? If it's not, he can 100% claim that the card that was sent to him is not what was advertised.

Fair enough - I didn't mean to imply otherwise. I've bought some graded cards from Collector's Cache before and they were as advertised. My suspicion is that the serial number will be identical, but the OP should absolutely check.
Sorry for not being more clear. The card that was sent to me is the exact card, with the above referenced serial number. I was originally responding specifically to the questions about the potentially stock pictures of the back of the card so that is what may have caused the confusion.
At this point, I haven't taken any action and still haven't decided how I would like to proceed. Either way, it's going to take more time and energy than it's worth. Sometimes that's just how it goes... But as I had mentioned before, the main purpose is for me to share my experience so the community is at least aware of what happened here (from my point of view). The store doesn't want to be accountable, eBay doesn't want to be accountable, PayPal doesn't want to be accountable, the Credit Card company doesn't want to be accountable, BGS doesn't want to be accountable, so who's left....? That's right... the "sucker" buyer. It's fine ... Personally, life is really bigger to me than this. Even though I'm a business owner myself, it's not up to me to tell someone how they should run their business or where their ethical lines should be drawn. So I didn't argue or get upset. I just choose to disagree and share my experience. Going forward, I know what these guys are about and how they run their business. Yes, from this one transaction I can conclude these guys are not a business I want to support.
I'm not going to draw any conclusions about BGS, eBay, Paypal or my CC company as it is very clear to me who should have been "most" accountable in this case.

Hey bud, one more random thought for you. Have you talked to Collector's Cache about this: What if you pay for the fees associated with this transaction back to them and shipping to get it back? It would make the seller whole and their effort would simply be in relisting the item. It'll cost you some in the interim, but might be the most amenable solution to the problem and will not leave you with a card you do not desire. Just a thought, not sure if they'll go through with it.
Given this card was described as "Gem Mint" and it is clearly not in mint condition, you have excellent grounds to open a case on eBay. I would recommend you proceed with this route first, since you have already attempted to work with the seller to no avail. It is the seller's responsibility to ensure that the item matches the auction title/description. I would anticipate that eBay will side with the buyer (you) as they do in most cases, especially since you have pictures documenting this discrepancy. You would have to send the card back at eBay/the sellers's expense and be refunded appropriately. If for some bizarre reason eBay decides not to side with you, you can always proceed with a charge back via your credit card company.

The OP already mentioned that they opened a complaint with eBay which was closed within a few hours.
I used to do a lot of trasactions as both seller and buyer and eBay started sucking something royal about ten or so years ago. Specifically, eBay changed a number of policies to greatly favor larger, high dollar/volume, sellers and place the majority of buyers and small sellers at a disadvantage. In essence, unless the OP has unequivocable proof the seller ripped him off, I don't think it's very likely eBay will side with him.
Especially interesting is the sellers attitude about a chargeback and how it'll hit only PayPal, not the seller. That hints to me that PayPal is still cheesy and likely follows the same rot policies as eBay. If you think it's hard to deal with eBay, PayPal is downright draconian.
