Whatever he might or might not win during a lawsuit is irrelevant, unless your prime motive is to see individuals fry (him or not him).
What is relevant is that all mtg-customers should WANT him to sue. Because when he sues, SCG (who is holding WotC's hand) would have to dig into the game play itself in order to explain his guilt. And once they have to do that alot of other wurms would crawl into daylight, putting forward examples of other players and their cheats might easily be done.
ON THE OTHER HAND, if SCG should loose (cheating havent been done) then the relationship between SCG and WotC would be put to test, who did what at which times, which people turned the blind eye, etc. The depth in this is NOT something SCG/WotC should show that they at ALL COSTS want to avoid, which is what they do when changing laws+giving to charity retroactively.
Give to charity is the filthiest trick in the book when being done in the way they did here.
