Problem would be if you're playing a control deck your opponent could deny your finishers ie. Aetherling.

There is plenty of reason for this card to be red. Not only does it work well enough mechanically (as the effect is somewhat unpredictable) but blue/red is a perfect match for the name.
This seems quite strong with pretty much anything graveyard-related, and may very well be good enough anyway. It's semi-complex, it's a splashy effect, and will be a desirable card due to FoF nostalgia. I have no problem with this as a rare, unlike Thoughtseize which should never have been rare to begin with.

If I were in this situation, it would be bad lol. I am not a major modern player, but judging on the cards I would probably give you the clique "pack" Command is REALLY good with its modes, and with snapcaster you can cast it twice. You can use repeal to repeat the process with clique, but you might have to use it on something I have. and fetchland does give you a land drop.

Clique+repeal+tarn, and I don't think it's that close. I'd probably split Tiago+Repeal+Tarn or Tiago+Clique.
Edit: I was using the Tarn as the least valuable card, which only really applies if they don't know whether you're light on mana. If this were on turn 5+ off of only 4 lands I think the original split is correct, and I give you Snap+Command.
If this is real it will easily see play. Fact or Fiction is one of the best blue draw spells and making it multicolored (a true drawback) + swapping who picks what (maybe a drawback and maybe not) is nowhere near enough to make it unplayable.
I'm quite sure this effect is significantly worse than Fact or Fiction. With FoF, you always have the option of picking the card you need most; I've seen plenty of 4/1 splits where the 1 was taken. Unless you're in the rare situation where it's worth it to try and deceive your opponent, he'll have a solid idea of which pile to give you based on the board state and your piles. It should still be a good option in constructed, but by no means a staple, IMO. Assuming this is real, which I hope it is. Games within the game always make for fun cards.

Pretty killer pull. All those cards are good, but I would probably go with the 3 cards.
If I'm combo, probably the 3 cards, unless I can fight through 2+ counters. Although giving you Cryptic could be good if I knew I could fight through it. I would be more worried about counter, snap counter than Cryptic with most combo decks. This is assuming I'm a position to go for it in 1-2 turns.
If I'm aggressive, probably the 3 because Command into Snap Command is pretty brutal. If I'm control, it depends on where we are on lands, and whether you need another blue, but most likely the 3 cards. Repeal isn't usually very good in control on control, and I can always use otherwise dead removal on Clique.
Powercreep isn't modern's fault. Gifts ungiven is better then FoF in modern and sees little play so not sure why FoF would be op. They just wanted to try something a bit different, with a homage.

Vexing Devil is doing just fine. It is just most punisher cards that are underpowered. I don't think this one is.
so if you get 2 good cards, put one in each pile and make the piles 2--3. If you get 3 good cards, put the strong one in one pile and the 2 others in the alternate pile.

Fact or Fiction has been deemed too powerful to reprint into Standard since Invasion rotated out; I doubt making it U/R and letting the player casting it decide what their piles are will change that.
Also, the people complaining about the rarity is laughable. I'd rather pull this in my Rare slot than Psychic Intrusion. And yes, it would be too powerful for limited at Uncommon. If you can't see that, then you probably aren't that in tune with evaluating cards.
But truthfully, it's more than likely fake. The artwork in the image is far too muddled compared to the relatively crisper card frame. It's a poor quality render and attempt at a fake.
ITT: Everyone who has done no extensive testing and has no experience working in development continues pretending they could do development's jobs better.
I'm really glad the MTGS user base isn't MTG development because they'd assign card rarity based on gut feelings and above all else never consider complexity or limited in rarity.

Not quite. They recognize those things, but they dismiss a card like this as simple (which requires a significant aside from the game as both you and your opponent fiddle with these cards) and bad in limited.
They know what to look for. They're just really bad at looking for it.
