1. Is it legal to extract data about decks and played games from MTGO using screen recognition software and use it for some purpose? I know about MTGGoldfish case, but AFAIK wizards asked them to stop publishing data about metagame rather than stop harvesting it. Just want to be sure.
2. Do MTGO draft logs fall under copyright? MTGO EULA has line "You are strictly prohibited from engaging in, or assisting others to engage in, conduct that would damage or impair the property of Wizards including, without limitation, the following: (a) copying, distributing, transmitting, displaying, performing, framing, linking, hosting, caching, reproducing, publishing, licensing, or creating derivative works from any information, software, products or services obtained from the Game, Game Service or Software". Does posting MTGO draft log considered as 'copying information obtained from the Game'? Obviously it was done million times. Then why is it legal?
I would ask wizards of the coast, the owner of MTGO, both questions directly. We can ponder around those questions, but the only two answers that will save you from any trouble will be either the one that comes from WOTC or this one: "don't do the things you plan at all". I think it's okay to ask directly, that's what wizards have a customer service and a laws department for. They make enough money with all of us to let their staff write you an answer
