Imagine I have a Chalice of the void for 3, then a player casts his commander that cost 3 so it gets countered, the next turn the player plays the commander paying 5 mana, the cmc is 5 now or is still 3 for the chalice?
The Chalice will counter it again. Copying my answer from your other thread from a few minutes ago, the converted mana cost of a spell has nothing to do with how much was spent to cast it. It is a characteristic of the spell based on its mana cost, i.e. what's printed in the upper corner of the card. Additional costs such as the "commander tax" do not change that characteristic; in the case of a commander that normally cost 3 mana like say Leovold, Emissary of Trest, it's still 3.
I'm a former judge (lapsed), who keeps up to date on rules and policy. Keep in mind that judges' answers aren't necessarily more valid than those of people who aren't judges; what matters is we can quote the rules to back up our answers. When in doubt, ask for such quotes.

Everywhere but the stack the value of X in a spell is considered to be 0. When a spell with X in its casting cost is cast X will be whatever was chosen during the casting of the spell for cards that consider the CMC of a spell. Condescend with x=1 is cmc 2 and x=2 is cmc 3 for example.
