For the FNM promos, I am referring to any leftovers. I.e. if they didn't have enough people one week so those didn't get distributed, and so that is why some are collecting dust. I know this one store says they are not allowed to sell leftover FNM promos, and also say they are not allowed to give them away (the heck?). But other stores have no problem selling leftover FNM promos. I am just wondering, are stores allowed to sell leftover FNM promos, or even just give them away?
I don't believe stores are allowed to sell their FNM promos until the new promo replaces the current one. Still, my store was handing out Ghor-Clan Rampager (October promo) and Grisly Salvage (November promo) randomly to participants in late November.
When I used to run events, I would just give the promos away the next couple of months as long as I have them. We never sold any of the FNM promos we got, they were always given away. I do find it pretty shady when stores says they cant give them away but turns around and sells them on ebay or something.
Nope. Not a chance. Typically they are given out as rewards at other events. I've won several at legacy events as participation prizes. My local store also uses them as a prize to the casual free pauper tournament that they run.

Gotcha. It's just that I find it kind of odd where one store says "sorry, we can't give promos away. We also can't sell them," but two other stores in the area where I live have no problem selling me leftover promos.

So basically, this is kind of like Chick-fil-A's policy of throwing away excess food in stock every night they close.
The way we handled things at the shop I owned/ran the magic singles collection for, judged the tournaments for, etc, but the actual owner of the business ran the tournaments themselves. Any cards sold to me were free game for me to sell. Any promos given to the shop to hand out were to be handed out as prizes. We never had left over FNM promos though, it was mostly the gateway promos and such that we ended up with extras of that we would just hand out as extra prizes for our Saturday tournaments or otherwise. I always made sure the promos the shop was sent were used up as prizes. Often many of them would end up getting traded in/sold to me (As the magic singles guy) and we never ran into an issue with my selling them at that point, but only after they were handed out as prizes to someone. I never allowed him to sell his promos to me or anyone else because to my knowledge at the time, you weren't allowed to do that, you had to hand them out, if not at the normal time, then at a later tournament.

This myth has been circulating for some time. Wizards never asks for promos to be sent back, ever. As mentioned by several folks above, for some promos they will ask that you destroy any left-over promos. Leftover FNM promos are explicitly allowed to be given as additional prizes for future events.
I've been a TO for over a decade. I don't recall any program ever where wizards asked for leftovers to be sent back. Besides the fact that with the difficulty of running a business, returning leftover cards via the US Mail would be the last thing on most people's minds
There has to be a time frame to where they can or cant sell promos. I know of multiple stores selling FNM promos from years ago. Cards like FNM Remands and Kitchen Finks. Of course these cards have been traded in or sold to the store for some reason and they are reselling them. They are larger stores and I have never hear of them getting in trouble for doing it.
As has been said by others, if the promos are provided for prize support they are required to be given away as prizes.
If the cards are purchased, whether from the initial prize winner or someone else, it's not a problem. However, if I were running a store I wouldn't risk selling such cards until a few months after their release just in case there was somebody who wanted to be an ass and report it to WotC for whatever reason.

Stores absolutely cannot sell leftover promos. FNM promos that are left from un-run FNM's must be returned to WotC, Gateway promos can be given out at later events, but none of them are ever allowed to be sold instead of given out.
Unused FNM promos don't have to be returned but they do have to be used as prizes for subsequent FNMs. If your store doesn't give away the promos one week then have to wait until the next month and then give them away. My LGS always gets 8 for each week, as attendance is 100+, but only gives 4 and raffles off the previous promos.
Selling promos instead of giving them away is bad for business in the end. Why would anyone pay for something they could probably get for free elsewhere? Some promos you can't even give away though. Many of those Gateway/WPN promos just stacked up at my old LGS and even after giving out full playsets there were still alot left because people were refusing to take them. I'm glad Wizards quit making those because they sucked for the most part.
Haven't been to my LGS in ages, but they are a nice family business and they typically give away older/left over promos to non-winners at FNM. I always thought it was cool/nice of them.
Just curious, what are these "gateway" promos people are talking about? A quick search resulted in finding information that they were discontinued in 2008 and was replaced by the Wizards Play Network, but does that still go on?
